Professional Experience

José Carlos Whale is Veirano Advogados' Legal Practice Director – member of the firm’s Management Committee.

José’s legal practice comprises both Civil and Labor Law. His experience with Civil Law consulting and litigation has been particularly focused on cases of contractual and statutory liability (civil law); negotiation and termination of contracts, especially software licensing and agency/distribution; consumer law under the perspective of the manufacturer/retailer only, including recalls; prevention of and remedies for unfair competition practices, e. g., violation of proprietary information.

In the field of Labor Law, José is used to provide legal support to HR in cases that require creative and business-oriented solutions, including litigation, such as localization and implementation of compensation/benefits policies, including stock options and bonuses; termination of employment; employee relocation and transfer; special employment conditions, including confidentiality and non-competition duties; e-mail monitoring and internal investigations.

The combination of his experience with Civil and Labor Laws qualifies José to provide legal services in connection with independent services providers who could represent Labor liabilities under the statutory system.

José provides free mentoring to entrepreneurs supported by Instituto Empreender Endeavor Brasil, a non-profitable organization that fosters new national ventures. His professional experience is highly recommended by several international rankings that researches the legal industry worldwide, such as Chambers & Partners and Who’s Who Legal.

He participated in the publication Labor Reform in Brazil published in the Brazil Business Report from Brazilian-American Chamber of Commerce, Inc.
